Visitors of the Website ("User" or "you") may use the Website only on condition that they accept the Terms of Use read and understand the Privacy Policy. Any further use of the Website or any part of it means you have read and understood theTerms of Use and the Privacy Policy , and agree to be bound by all parts of the Terms of Use.

The information on this Website is for general informational purposes only. Information on this Website does not constitute an offer binding to us. Binding agreements with suppliers of travel services on the Website require a booking request through the platform from your side and the supplier's acceptance of this request according to the Terms of Business.

The Website and all its content is protected by copyright. You may access and view the Website, but not incorporate it into other websites, and not copy, present, license, publish, download, upload, send or make it perceptible in any other way without our prior written consent.

We try our best to ensure that the Website is always available and the information in or through the Website is accurate. However, we may not provide any warranties in relation to this website or the information and materials provided on this website. And where we link to third party websites, you use such websites at your own risk.

Without prejudice to the generality of the foregoing paragraph, vemgoo.com does not warrant that: this website will be constantly available or available at all; or the information on this website is complete, true, accurate or non-misleading (including for any information provided by third parties). We may change, add or remove information on the Website and change its functions and structure at any time, and without specifically informing about such change, and without removing outdated information or characterizing it as such.

We do not assume any responsibility for third party content on our website (including the listed offers). And we exclude our liability, and that of our agents and suppliers, and our and their employees and officers, for damages relating to your access to (or inability to access) the Website, or to any errors or omissions, or the results obtained from the use, of the Website, whatever the legal basis of such liability would be.

These Terms of Use and any disputes arising out of or in connection with it are subject to the substantive laws of Germany.

About our users

To create an account on Vemgoo you need to be at least 16 years old. To book an activity on Vemgoo you need to have a credit or debit card that we accept (see below for details of current payment providers). You need to be allowed to use this credit or debit card. If it’s not in your name, you need to have permission.

Promo Codes

From time to time, we may give you Promo Codes that you can use to reduce the price of specified products. Remember, it’s up to you to enter the code at checkout!

Here are some key things to remember:

Each Promo Code has its own terms, which will be made clear at the time it’s issued to you (e.g. what products, single/multiple uses, when it can be used etc). You are responsible for following the conditions given to you with each promo code.

If you’re given a unique Promo Code that is meant just for you (e.g. a student Promo Code) please keep it secret and don’t let anyone else use it or abuse it (e.g. don’t post it on social media). We are not responsible if someone took your Promo Code without your consent and used it. If we think there is or has been a misuse of a Promo Code in any way (e.g. selling it or sharing it with others), we can cancel your Promo Code and/or suspend or even close your account without telling you. We don’t like to do this, but if a Promo Code can’t run properly because someone or something is spoiling the fun for everyone – e.g. fraud, tampering, technical errors or anything else that is beyond our control that affects the running or fairness of the Promo Code – we can cancel, modify or suspend the Promo Code.

User-Generated Content T&Cs

Have we reached out to you on social media to feature your content on our social media channels? Congrats! It means we love your content. By giving you the opportunity to feature your content on our social media channels and by responding with the required hashtag (such as #Vemgoo) you agree: we can use your handle and the content (the “Content”) on vemgoo.com and/or on any of Vemgoo’s social media platforms (including but not limited to Instagram, Facebook and Twitter). we can edit, crop, adapt, enhance or modify the Content (but Vemgoo will not treat you in a derogatory manner).

You promise that you:

  • have the permission of everyone in the Content;
  • have the right to grant Vemgoo the above rights;
  • are at least 16.

If you (or anyone in the Content) asks us to remove the Content, we will remove the Content from the social media accounts that we control. You understand that other users of these social media platforms can also share and make use of the Content once posted. In particular, a user of these platforms can take a screenshot of and save an image of the Content to their device, share the Content on social media platforms or websites which feature the Content (and sharing capabilities). If you do not want to grant the permissions set out above then please do not give us consent to use the Content

Terms of Business

These Terms of Business apply for any usage of the vemgoo.com website and you must agree with these Terms of Business whenever using the site. vemgoo.com is a community-driven marketplace for sports & activity services. The contracts are concluded directly between seller and buyer. vemgoo.com is not a contracting party for any booked service but acts solely as the mediator and facilitator of sales and purchases done between the seller and buyer.

Be aware that general terms, travel conditions, price and conveyance of a particular individual service provider will apply to the contents of the agreement between the customer and the service provider. These conditions may govern the conditions of cancellation, booking alterations, payment, deadlines, reimbursement, liability as well as other details of the agreement.

The listed services on the Website are non-binding offers.

Customers are not permitted to make any speculative, false or fraudulent bookings. If we are reasonably of the opinion that such a booking has been made we shall have full right to cancel the booking and inform the relevant authorities of the respective countries.

Customers need to provide correct and accurate email, postal, personal and/or other contact information to us and give us the right to use these details to contact you in case that it should prove to be necessary. If you do not give us all of the information that we need, we may not be able to complete your booking. You shall be liable to us for any costs sustained due to any false or fraudulent bookings and/or contact and personal information made or given by you.

If the customer accepts the supplier's offer by booking a service, the contract between the customer and the supplier becomes effective and the supplier's cancellation terms begin to apply. The customer is then bound to pay for the requested service by the chosen payment method in the booking process and in line with the Payment Policy as defined by the supplier in the listing.

vemgoo.com uses Stripe and Paypal as the Payment Providers to process the payments on the Website. By agreeing to these General Terms and Conditions, you also accept Paypal's and Stripe's Terms and Conditions, which can be found here: https://www.stripe.com and here https://www.paypal.com.

After the customer completes the booking, the supplier becomes bound to provide the booked services as described in the offer. If for whatever reason the supplier is unable to provide the booked services, the supplier and customer have to resolve the situation directly between themselves and so that the costs for the customer will be as low as possible. The supplier provides the services under his own behalf and on his own account.

Customers have the right to cancel booked services. The refund needs to be arranged vemgoo and the customer. The refund needs to be in line with the supplier's cancellation policy for that particular offer as stated inside the supplier's listing on vemgoo.com. The supplier decides himself what cancellation policy he will use. Unless the service provider defines their individual cancellation policy, vemgoo provides three cancellation options suppliers can choose from:

The guest is entitled to the following refunds expressed in percentages of the total booking value in case of cancellation at a certain time before the experience starts:

  • Flexible policy: 100% refund for cancellations of more than 24 hours before the start.
  • Medium policy: 50% refund for cancellations of more than 7 days before the start.
  • Strict policy: 0% refund for cancellations.

In the rare event that within 24 hours after receiving the booking confirmation a customer finds the exact same offer cheaper somewhere else on the web then he could be entitled to claim for a monetary compensation on the basis of our "Best Price Guarantee".

The supplier may set certain requirements for his offers in the offer description. It is the responsibility of the customer to fulfil these requirements. In case the customer does not fulfil these requirements, the supplier is entitled to disapprove or exclude him from a certain service. In this case, the customer loses his right to be refunded. A whole or partial refund can then be negotiated directly between the supplier and the customer.

After completion of the booked service, the customer is asked to review the booked service using the vemgoo.com review system. The review system aims to create a meaningful and accurate image of the quality, reliability and trustworthiness of the supplier. The customer has to make only factual and truthful statements. Inaccurate, irrelevant or insulting comments are not allowed. vemgoo.com explicitly reserves the right to delete such comments without further notice. vemgoo.com also has the right to exclude customers from further use of the vemgoo.com booking platform. vemgoo.com and affected suppliers reserve the right for further legal action, in particular, compensation of damages.

The user understands that vemgoo.com links them up to adventure activity providers.

The user understands that doing an adventure activity comes with risk and won't hold vemgoo liable for injuries sustained during any activity. vemgoo.com is only liable to customers and suppliers in cases of gross misconduct on its own (including gross negligence). vemgoo.com is not liable for slight negligence, auxiliary persons and the mediated suppliers, customers and their auxiliary persons. The liability is limited to the immediate damage, excluding consequential damages, loss of profit etc. The liability for punitive damage compensation is also excluded. Further limitations of liability or liability exclusions in these Terms or applicable legal provisions are reserved.

The legal relations with vemgoo.com are exclusively subject to German law.
